How New Jersey Law Governs Parenting Time

N.J.S.A. 9:2-4 is the primary statute governing custody and parenting time in New Jersey. Substantially amended in January 2026 by S4510/A5761, the revised law represents a meaningful shift in how courts approach these disputes. Under the amended statute, child safety now functions as a threshold issue courts must address before turning to schedule or structure. The prior default presumption favoring frequent and continuing contact with both parents has been removed.

New Jersey custody law is gender-neutral. Courts evaluate both parents under the same statutory framework without a built-in preference for either. The best-interests standard governs all decisions, and under the 2026 amendments, that standard incorporates a safety-first analysis, weighing any evidence of domestic violence or abuse before other factors are considered.

The revised statute also requires courts to consider the expressed preferences of children of sufficient age and maturity. If a judge orders an arrangement contrary to a child’s stated preference, the judge must explain that decision on the record. New Jersey courts refer to the custodial parent as the parent of primary residence and the non-custodial parent as the parent of alternate residence. Parents who agree on a schedule may do so without court intervention; if they can’t, the court may impose one after evaluating the statutory factors.

Types of Parenting Time Arrangements in New Jersey

Courts can approve a wide range of parenting time structures depending on the child’s age, each parent’s circumstances, and any safety considerations. Three arrangements come up most often:

Shared Parenting Plan
The child spends equal or nearly equal time with each parent. Schedules may alternate weeks or use shorter time blocks, with shorter rotations often better suited for younger children who benefit from more frequent contact with each parent.

Traditional Parenting Plan
The child lives primarily with the parent of primary residence. The parent of alternate residence typically has parenting time on alternating weekends and one or two mid-week visits. Holidays, birthdays, school breaks, and transportation logistics are addressed in the written plan.

Supervised Visitation
Visits take place in the presence of a court-appointed supervisor. Courts may order supervision when a parent’s history raises safety concerns, including a history of abuse, substance abuse, or mental health issues. New Jersey’s Supervised Visitation Program allows court-ordered sessions at the courthouse or an approved community organization. Supervision is generally intended as a temporary measure; courts may require the supervised parent to complete parenting classes, substance abuse counseling, or therapy before transitioning to unsupervised parenting time.

Parents may agree on any schedule that serves the child’s best interests. Agreements reached in mediation can be formalized as a Consent Order once signed by both parties, their attorneys, and the judge.
