What is involved in the adoption process?

We understand that it is important to you that the adoption process is as quick and painless as possible so that you and your family can move forward and begin to build a new life. Thus, it is essential that you have legal counsel that is experienced and familiar with New Jersey adoption laws. After the birth parents consent to an adoption, the potential adoptive parents will undergo a home study to determine whether or not they are fit to be parents. The home study will be conducted by a social worker and will evaluate issues relating to financial and marital stability, lifestyle and career obligations, physical and mental health, and the involvement of other children. The report will be provided to the court as the legal process ensues.

Along with the report, an adoption petition will be filed. This petition will include:

  • Names, ages, and address of adoptive parents
  • Name, age, and parentage of child
  • Description of relationship between adoptive parent and child
  • Legal reason for termination of birth parents' rights
  • Proof of adoptive parents' eligibility
  • Proof that child's best interests are being upheld

Other documents that will be filed with the petition include the written consent of the birth parents and any requests for the child's legal name change. The court will then hold an adoption hearing to make an ultimate decision regarding whether or not the adoption is in the child's best interest. If the adoption is approved, the judge will issue a court order, or a final decree of adoption, that will finalize the process and legalize the relationship between the child and his or her new parents.
