Creditors' Rights/Collections

Our creditors' rights and collections practice in New Jersey and New York includes advice and representation in the areas of bankruptcy, foreclosures, and collections. Bankruptcy

At Levy, Ehrlich & Petriello, our bankruptcy attorneys, with their broad and extensive knowledge of bankruptcy law, represent commercial lenders, secured lenders, landlords, trustees, regulatory agencies and other creditors in New Jersey and New York bankruptcy proceedings.

When a debtor declares bankruptcy and attempts to discharge debt or reorganize its debts, secured and unsecured creditors need to act quickly. An automatic stay in bankruptcy can halt your collection efforts. Our bankruptcy lawyers have the experience to proceed on a bankruptcy matter with speed and efficiency.

We have represented many clients to seek relief from the automatic stay, and to prosecute and defend adversary proceedings before the Bankruptcy Court. We have also defended numerous clients for preference actions arising from payments made to creditors prior to the filing of a bankruptcy petition.

Collections in New Jersey and New York

Our collection attorneys know the failure to collect accounts receivable can put a strain on any business. All of our collections lawyers work hard to get results quickly and efficiently. If it is necessary to sue to recover on lien claims, bond claims, unsecured commercial receivables or retail receivables, or any other amount due, our collection attorneys have the courtroom experience to aggressively litigate any collection claim.

Foreclosures in New Jersey and New York

Our extensive experience in real estate matters, and foreclosure procedures enables us to effectively guide clients through the foreclosure process, completing contested foreclosures and uncontested judicial foreclosures as promptly as possible. We represent New York and New Jersey secured creditors, and have represented the United States Department of Justice in the foreclosure of properties in the state of New Jersey.

We represent clients for foreclosures arising from the failure to pay mortgage obligations. We also represent clients in tax foreclosure proceedings, where properties are foreclosed upon for failure to pay real estate taxes. We can guide you through the entire process, from initiation of proceedings through the disposition of property at a sheriff's sale.
